Pekerja ialah individu yang bekerja di bawah seliaan majikan. Di Malaysia, hubungan antara majikan dan pekerja di kawal oleh undang-undang buruh. Perkembangan undang-undang buruh di Malaysia bermula apabila ramai buruh Cina dan India dibawa masuk ke Tanah Melayu untuk bekerja di kawasan perlombongan dan perladangan. Undang-undang buruh mula diperkenalkan sedikit demi sedikit. Dalam hal ini, ramai yg memilih definisi dalam Akta Kerja 1955 dimana semua pekerja eksekutif dan bukan eksekutif dilindungi dibawah Akta yang sama. Maka, apakah definisi sebear "PEKERJA" diadalam Akta Kerja 1955?

Mengikut Seksyen 2 Akta Kerja 1955, kontrak perkhidmatan mana-mana perjanjian sama ada lisan atau bertulis dan sama ada nyata atau tersirat, di mana seorang bersetuju untuk mengambil bekerja seorang lain sebagai pekerja dan orang lain itu bersetuju untuk berkhidmat dengan majikannya sebagai pekerja dan termasuklah kontrak perantisan. Namun ada sesetengahnya lebih dikenali sebagai kontrak bebas kerana diambil bekerja melalui kontrak untuk perkhidmatan. Namun, apakah keputusan Mahkamah Persekutuan?
